These Terms of Service ("Terms") govern your access to and use of uniquebathseattle.com and the related tools we offer — including the Shower Visualizer, the Design Studio, lead forms, and consultation booking (collectively, the "Services") — provided by Unique Bath of Seattle ("we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you meet this requirement and that the information you submit is accurate.
2. What the Services Are
The Services are designed to help homeowners explore walk-in shower and bath remodel options before requesting a consultation. They include:
- Shower Visualizer — upload a photo of your bathroom and we generate an illustrative preview of how a new shower could look in that space.
- Design Studio — browse wall finishes, hardware options, patterns, and accessories.
- Lead forms and consultation booking — request information, pricing, or a no-obligation in-home consultation.
The Services are informational and inspirational tools. They do not constitute a binding offer, design contract, or warranty. Any actual remodel is governed by a separate written agreement signed at the time of purchase.
3. AI-Generated Visualizations — Important
Final design, materials, hardware, and feasibility are determined during your in-home consultation and reflected in your signed contract, not in any image generated by the Visualizer. AI-generated images may contain artifacts, inaccuracies, or features that we do not actually offer or that cannot be installed in your space. Do not rely on a visualization as the basis for a purchasing decision in lieu of an in-home assessment.
4. User Content (Photos & Submissions)
When you upload a photo to the Visualizer or submit information through a form, that content ("User Content") remains yours. You grant us a non-exclusive, royalty-free, worldwide license to use, store, process, and display your User Content for the purpose of (a) providing and improving the Services, (b) responding to your inquiry, and (c) contacting you about your project.
You represent that you have the right to submit your User Content — for example, that you own or have permission to upload any photo you submit, and that nothing you upload infringes someone else's rights or applicable law. We may decline to process or remove any User Content at our discretion. We will not publicly publish identifiable photos of your home without your separate consent.
Photos submitted to the Visualizer are processed by third-party AI providers as described in our Privacy Policy.
5. Estimates, Pricing & Quotes
Any pricing ranges, sample numbers, or design configurations shown on the Services are estimates for general guidance only. They are not binding quotes. Actual pricing depends on your specific project scope, site conditions, materials selected, permitting, scheduling, and other factors evaluated during the in-home consultation. A binding price is provided only in a written, signed agreement.
6. Communications & SMS
By providing your phone number through any form on the Services or in a Meta (Facebook/Instagram) Lead Form, you agree that we may contact you about your project — including by phone, voicemail, prerecorded message, automated technology, and SMS/text. Consent to these communications is not a condition of purchase. Standard message and data rates may apply. You can opt out of SMS at any time by replying STOP to any text or by calling us at the number below; reply HELP for assistance. Full details are in our Privacy Policy.
7. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms
- Upload content you do not have the right to share, or that contains nudity, violence, hateful content, or anything depicting a minor inappropriately
- Attempt to access non-public areas of the Services, including admin tools, by guessing credentials or exploiting vulnerabilities
- Scrape, copy, or systematically extract Services content without written permission
- Interfere with the operation of the Services, including by transmitting malware, sending excessive automated traffic, or probing for weaknesses
- Misrepresent your identity, contact information, or relationship to a property when requesting a quote
- Use the Services to harass us or our personnel
8. Our Content & Intellectual Property
The Services — including text, graphics, logos, photos, designs, software, the look and feel, and other content (excluding your User Content) — are owned by us or our licensors and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Services for your personal, non-commercial use of evaluating our products and services. All other rights are reserved.
9. Third-Party Services & Links
The Services may rely on or link to third-party services (for example, AI image processors, scheduling tools, hosting and CDN providers, advertising platforms, and external websites). We are not responsible for the content, policies, or practices of those third parties. Use of those services is governed by the third party's own terms.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT VISUALIZER OUTPUTS WILL BE ACCURATE, COMPLETE, OR REFLECTIVE OF THE FINAL INSTALLED PRODUCT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL UNIQUE BATH OF SEATTLE OR ITS OWNERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR DIMINISHED VALUE — ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. THIS SECTION DOES NOT APPLY TO LIABILITY UNDER A SEPARATE SIGNED REMODELING CONTRACT, WHICH IS GOVERNED BY ITS OWN TERMS.
12. Indemnification
You agree to defend, indemnify, and hold harmless Unique Bath of Seattle from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Services, or your violation of these Terms.
13. Governing Law & Venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and you and we consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. If we make material changes, we will use reasonable efforts to notify you (for example, by updating this page or sending an email). Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including Sections 4, 8, 10, 11, 12, and 13) will survive.
